Who we are

This website is operated by Patrick VDV (Pty) Ltd, a private company registered in South Africa ("we", "us", "our"). We publish and sell music under the artist name GO VDV (Patrick VDV & Riyago). When you use this website or buy our music, you are contracting with Patrick VDV (Pty) Ltd.

Throughout the site, the terms "we", "us" and "our" refer to Patrick VDV (Pty) Ltd. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms stated here.

Acceptance of these terms

By accessing or using this website — including browsing, playing our game, joining the fan programme or making a purchase — you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the website.

If you are using the service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual, you confirm you are of legal age to enter into contracts in your jurisdiction (or have a parent or guardian's permission).

What we provide

We provide this website as a home for our music releases, videos, fan community features (points, badges, missions, secret codes and a game) and digital products such as hi‑quality streams, MP3 downloads and behind‑the‑scenes content. Digital content you unlock through a purchase is licensed to you for personal, non‑commercial use.

Your account and details

Where the site stores progress on your device (for example fan points, badges or unlocked content), you are responsible for that device. If you create credentials in future features, you must keep them confidential and are responsible for all activity under your account. You agree to provide accurate information where required and to keep it up to date.

Acceptable use

You agree not to misuse the website. In particular, you must not:

  • use the website for any unlawful purpose or in violation of any applicable law;
  • engage in fraud, spam, phishing or harassment;
  • infringe our intellectual property or that of others, including copying, redistributing or reselling our music or content without permission;
  • interfere with the security or operation of the site, including introducing malware, probing or scanning vulnerabilities, scraping at scale, or circumventing technical limits or access controls;
  • reverse engineer the service except as permitted by law.

Intellectual property

All content on this website — including our music, artwork, videos, logos, the GO VDV brand, software and page design — is owned by or licensed to Patrick VDV (Pty) Ltd and is protected by copyright, trademark and other intellectual property laws. We retain all ownership of the service and its content. Nothing in these terms transfers ownership to you.

We grant you a limited, non‑exclusive, non‑transferable licence to access the website and use purchased digital content for your personal enjoyment within the scope of your selected purchase. You may not resell, redistribute or publicly perform our music or content without a separate licence from us.

Payments, billing and taxes

Purchases on this site are one‑off digital purchases (pay‑what‑you‑want support) unless a subscription is offered in future. Prices are shown in US dollars at checkout; applicable taxes are handled at checkout. Billing frequency, cancellation and refund mechanics are described in our Refund Policy.

Our reseller Paddle (Merchant of Record)

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Service availability

We work hard to keep the website available and error‑free, but we do not guarantee uninterrupted or error‑free performance. The service may be updated, paused or changed, and features may be added or removed over time.

Suspension and termination

We may suspend or terminate your access to the website or parts of it if:

  • you materially breach these terms;
  • payment is due and unpaid where applicable;
  • your activity poses a security or fraud risk; or
  • you repeatedly or seriously violate our policies, including acceptable use.

If your access ends, any device‑stored progress and unlocked content may become unavailable. Where content was validly purchased, we will use reasonable efforts to restore access or, if that is not possible, you may seek a refund through Paddle as described in our Refund Policy.

Disclaimers

The website and all content are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, our aggregate liability to you for all claims arising from or relating to the website or your purchases is limited to the total fees you paid to us in the six (6) months before the claim arose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, death or personal injury caused by negligence.

Your content

If you submit content to us (for example messages or support requests), you grant us a limited licence to host and process it solely to provide and improve the service. You confirm you have the rights to any content you submit. You indemnify us against claims arising from content you submit, unlawful use of the website, or violations of these terms.

General

Governing law: These terms are governed by the laws of South Africa, and the courts of South Africa have exclusive jurisdiction over disputes, without affecting your mandatory consumer rights.

Assignment: You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition or sale of our business.

Force majeure: We are not liable for delays or failures in performance caused by events beyond our reasonable control.

Changes: We may update these terms from time to time. The current version is always available on this page, and continued use of the website after changes means you accept the updated terms.
